Prog Leasing LLC sued for nuisance robo-calls

ORLANDO — An individual is suing Prog Leasing LLC, a Utah corporation, citing alleged violation of Telephone Consumer Protection (TCPA).

Carlton Williams filed a complaint on Oct. 14, in the U.S. District Court for the Middle District of Florida Orlando Division against Prog Leasing LLC alleging that the Utah corporation violated TCPA through intrusive and unwanted calls.

According to the complaint, the plaintiff alleges that, in 2015, he received approximately 75 calls on his cellular telephone from the defendant in its attempt to collect an alleged debt, using an automatic telephone dialing system (ATDS) and/or an artificial or prerecorded voice. The defendant ignored plaintiff's demands to cease calling him, thereby causing plaintiff to suffer from incoming call charges, nuisance and invasion of privacy, the suit alleges. 

The plaintiff holds Prog Leasing LLC responsible because the defendant allegedly contacted plaintiff without acquiring prior express consent, provided no means for the plaintiff to have his cellular number removed from its ATDS, and called plaintiff with such frequency that it amounted to harassment or abuse.

The plaintiff requests a trial by jury and seeks judgment against defendant, damages, costs, interest, attorneys' fees and other relief the court may deem just.
