Husband and wife sue semi-truck driver over alleged negligence

TAMPA — A couple is suing Edward Tibor and Swift Transportation Co. of Arizona LLC, semi-truck driver, citing alleged insufficient measures were taken to prevent injuries and negligence.

Mark and Wanda Weiss filed a complaint on Oct. 13, in the Hillsborough County Circuit Court against the defendants alleging that they failed to exercise standard care and skill required of a professional driver.

According to the complaint, the plaintiffs allege that, on May 6, 2013, Mark Weiss was driving near the intersection of County Line Road and New Tampa Highway, when the semi-truck owned by Defendant Swift and driven by Defendant Tibor suddenly collided with his vehicle, causing serious and permanent injuries, including pain and suffering, mental anguish, physical impairment, disfigurement and scarring, and loss of earnings. Moreover, his wife, Plaintiff Wanda, had suffered the loss of comfort, companionship and consortium of her spouse, and incurred medical expenses in seeking a cure for her husband. 

The plaintiffs hold Edward Tibor and Swift Transportation Co. of Arizona LLC responsible because the defendants allegedly failed to properly maintain and operate a semi-truck and failed to defensively lookout for other vehicles on the road.

The plaintiffs request a trial by jury and seek judgment against the defendants, and for any other relief as the court deems just. They are represented by Michael L. Walker of Florin Roebig PA in Palm Harbor.
