Tampa consumer claims Synchrony Bank harassed her with phone calls

TAMPA – A Tampa woman alleges a bank harassed her with frequent phone calls.

Darte Gomes filed a complaint on Oct. 7 in the Tampa Division for the Middle District of Florida against Synchrony Bank citing the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that beginning in November 2015, she began receiving calls to her cellular telephone from defendant seeking to recover an alleged debt that she was making payments on. She alleges some of the calls were made using an automatic telephone dialing system or an artificial or prerecorded voice. On May 4, she demanded the defendant to cease calling her, but each of her requests were allegedly ignored, thereby causing her to suffer the injury of invasion of privacy and intrusion upon her right of seclusion.

The plaintiff holds Synchrony Bank responsible because the defendant allegedly continued to call plaintiff despite revocation of her express consent and unlawfully utilized an automatic telephone dialing system or a pre-recorded voice.

The plaintiff requests a trial by jury and seeks judgment against defendant, damages, costs, interest, attorney's fees, enjoinder from further violations and other relief the court may deem just. She is represented by Shaughn C. Hill of Morgan & Morgan in Tampa.
