EZX LLC, driver accused of wrongful death

JACKSONVILLE – The parents of a deceased woman allege that a trucking company and its driver are responsible for the wrongful death of their daughter.

Patricia Ann Johnson and Grover Bostick, personal representatives of the estate of and survivors of Kelly Black, filed a complaint on Sept. 29 in the 4th Judicial Circuit Court for Duval County Circuit against EZX LLC and Matthew M. Rau citing wrongful death, negligence and other counts.

According to the complaint, the plaintiffs allege that on Oct. 23, 2015, Black, daughter of plaintiffs, was ran over and dragged 400 feet under the wheels of a semitrailer driven by Rau, which consequently caused her death. As a result, the plaintiffs incurred medical and funeral expenses, suffered and will continue to suffer from loss of decedent's companionship, support, services, protection, and mental pain and suffering. 

The plaintiffs hold EZX LLC and Rau responsible because the defendants allegedly failed to properly train and instruct its driver on safe driving, failed to keep a proper lookout while operating the truck, failed to maintain a safe and proper distance for the circumstances and failed to recognize the hazards present.

The plaintiffs request a trial by jury and seek judgment against the defendants, damages, costs, expenses, interest and further relief the court deems just. They are represented by Daniel A. Iracki, Howard C. Coker and N. Joel Harris of Coker, Schickel, Sorenson, Posgay, Camerlengo & Iracki PA in Jacksonville.
