Select Portfolio Servicing accused of contacting man after he revoked consent

TAMPA – A Pinellas County man alleges a debt collector continued to call him despite instructing it to contact his lawyer.

James H. Epstein filed a complaint on Aug. 30 in the Tampa Division for the Middle District of Florida against Select Portfolio Servicing Inc. citing the Florida Consumer Collection Practices Act and the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that in 2015, he contacted the defendant by fax to revoke consent for it to contact him regarding a purported debt and for it to contact his counsel instead. The plaintiff holds Select Portfolio Servicing Inc. responsible because the defendant allegedly kept on calling and harassing plaintiff despite his request to stop calling him using an automatic telephone dialing system.

The plaintiff requests a trial by jury and seeks statutory damages and any other relief as the court deems just. He is represented by Christopher W. Boss of Boss Law in St. Petersburg.
