Baptist Medical Center claims Florida Blue owes for treatment of patient

JACKSONVILLE – A hospital alleges that an insurance company did not fully pay for emergency services provided to a beneficiary.

Southern Baptist Hospital of Florida Inc., doing business as Baptist Medical Center, filed a complaint on Aug. 5 in the 4th Judicial Circuit Court of Duval County against Blue Cross and Blue Shield of Florida Inc., doing business as Florida Blue, alleging unjust enrichment, violation of federal statutes and other counts.

According to the complaint, the plaintiff alleges that on Nov. 8, 2015, it treated and stabilized a patient covered by the defendant's insurance policy before transferring the patient to another facility. The plaintiff alleges it billed the defendant $1,314,176.05 for the emergency services supplied to the patient, but that the defendant only paid $345,998.42 and claimed the remaining balance was the patient's responsibility.

The plaintiff holds Blue Cross and Blue Shield of Florida Inc. responsible because the defendant allegedly failed to produce a copy of the insurance contract and failed to pay the full amount due despite the services offered being covered under the terms of the plan.

The plaintiff requests a trial by jury and seeks judgment against defendant for damages plus costs, interest, attorney's fees and any other relief that the court deems just. It is represented by Alan M. Fisher of Alan M. Fisher PA in Ponte Vedra Beach.
