Man sues Cawley & Bergmann over allegedly harassing calls

ORLANDO – A Seminole County man alleges that a debt collection company harassed him by repeatedly calling his phone seeking to reach a different person.

Domenick Lacertosa filed a complaint on March 9 in the U.S. District Court for the Middle District of Florida, Orlando Division against Cawley & Bergmann LLP, citing violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that he received numerous non-emergency calls from the defendant without his prior express consent. The plaintiff holds Cawley & Bergmann LLP responsible because the defendant allegedly continued to call him even after it was told that it was calling the wrong person and repeatedly asked to stop.

The plaintiff seeks the following: compensation for statutory, punitive, actual and treble damages and any further relief that the court may deem just and proper. He is represented by Octavio "Tav" Gomez of Morgan & Morgan, Tampa PA in Tampa.
