FORT MYERS — A Bonita Springs man is suing a creditor for alleged violation of telephone harassment laws.
Steven Davies sued Exeter Finance Corp. on Feb. 22, in U.S. District Court for the Middle District of Florida Fort Myers Division, alleging that the creditor used an automatic telephone dialing system and willfully violated the federal Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.
The plaintiff alleges that he has received numerous pre-recorded calls without his express permission. The plaintiff holds Exeter Finance Corp. responsible because the defendant allegedly made non-emergency telephone calls several times in the same hour, in the same day, and on back-to-back days.
The plaintiff seeks the following: compensation for statutory, punitive and actual damages, attorney's fees, costs and interest and any further relief that the court may deem just and proper. He is represented by Octavio "Tav" Gomez of Morgan & Morgan, Tampa, P.A. in Tampa, Florida.
