Class-action suit aims to stop actions of alleged foreclosure mill against homeowners

MIAMI – A class-action suit filed by a Brazilian citizen over family property in Florida claims several banks and law firms are pursuing unlawful foreclosures against thousands of Florida homeowners.

Alexander Eugenio Moskovits filed a class-action lawsuit in U.S. District Court for the Southern District of Florida against Aldridge Pite LLP (formerly known as Aldridge Connors, LLP), Sarah Barbaccia, Mindy Datz, Rosa M. Suttle, McGlinchey Stafford PLLC, Kevin Inman, Merscorp Inc., Mortgage Electronic Registration Systems Inc., HSBC Mortgage Corp., Rebecca Cosgrove, PHH Mortgage Corp., Daneisha Hunt, and John and Jane Does 1-10 as agents or employees of the defendants, alleging wire and mail fraud, unjust enrichment and violations of the Fair Debt Collection Practices Act and the Racketeering Influenced Corrupt Organizations Act.

The complaint says the lawsuit was triggered by two foreclosure attempts against property Moskovits co-signed a mortgage for with Mel Gorham. Both attempts were allegedly filed by banks that had been fraudulently reassigned the original loans through Mortgage Electronic Registration Systems (MERS), who therefore lacked legal standing to foreclose.

Moskovits and other members of the plaintiff class seek a jury trial and damages of more than $5,000,000. Moskovits is representing himself.
