Kenneth Cohen has filed a lawsuit against two companies, alleging negligence after sustaining serious injuries from a faulty elevator handrail. The complaint was filed on February 5, 2025, in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida, naming CC West Palm LLC and PP CWPB Investors LLC as defendants.
According to the complaint, Kenneth Cohen, a resident of Palm Beach County, was injured on March 7, 2022, while using an elevator at his residence managed by CC West Palm LLC. The handrail he was holding for support suddenly broke off, causing him to fall and suffer severe injuries. Cohen claims that both CC West Palm LLC and PP CWPB Investors LLC failed in their duty to maintain the premises safely. The plaintiff argues that the defendants had either actual or constructive knowledge of the dangerous condition posed by the faulty handrail but did not take necessary actions to rectify it or warn residents like him.
The lawsuit accuses both companies of multiple breaches of duty. It states that they neglected to maintain the elevator in a safe condition and failed to adequately train employees to identify and repair hazards. Additionally, they are accused of not restricting access to dangerous areas or providing adequate warnings about existing risks. "The existence of the faulty elevator handrail created an unreasonably dangerous and unsafe condition," asserts Cohen's legal team.
Cohen is seeking damages exceeding $50,000 for his injuries which include pain and suffering, disability, mental anguish, loss of earnings capacity, medical expenses, and other related costs. He also demands compensation for future losses due to the ongoing nature of his injuries.
