The plaintiffs, Deron and Cindy Kiefer, residents of Palm Beach County, claim that on August 14, 2023, while shopping at Lowe’s Store #1069 in Boca Raton, Deron was struck on the head by a heavy pipe that had been improperly placed. According to the complaint, this incident occurred due to negligence on the part of both Lowe’s and Eric Perry, who was serving as the assistant manager at the time. The plaintiffs argue that the defendants failed to maintain safe conditions within the store and neglected to warn customers about potential hazards. “Defendants knew or should have known of the dangerous condition,” states the complaint.
The lawsuit highlights several allegations against Lowe’s and Perry. It accuses them of failing to inspect and correct hazardous conditions, such as leaving large pipes unsecured in areas frequented by customers. Furthermore, it alleges that they did not implement necessary safety measures or provide adequate warnings about these dangers.
