A lawsuit has been filed against a major home improvement retailer, alleging negligence that resulted in significant personal injury. Lisa Hawkins lodged the complaint in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, on January 14, 2025, targeting The Home Depot, Inc., and Home Depot USA Inc.
The case revolves around an incident that occurred on May 16, 2021, at a Home Depot location situated at 220 S State Road 7 in West Palm Beach. According to the complaint, Hawkins was an invitee on the premises when she encountered a hazardous condition—a hole or divot on the floor—that had not been addressed by the defendants. The lawsuit asserts that Home Depot negligently maintained their property by allowing this dangerous condition to persist and failing to warn customers about it. "The negligent condition was known to defendant(s) or had existed for a sufficient length of time so that defendant(s) should have known of it," states the complaint.
As a result of this alleged negligence, Hawkins claims she suffered severe bodily injuries leading to pain and suffering, disability, disfigurement, mental anguish, and loss of enjoyment of life. She also cites expenses related to hospitalization and medical care as well as loss of earnings and earning capacity. The complaint emphasizes that these damages are either permanent or ongoing and will continue to affect her future quality of life.
Hawkins is seeking a judgment for damages exceeding $50,000 along with interest and costs. Additionally, she demands any further relief deemed appropriate by the court under these circumstances. A trial by jury has been requested for all issues eligible for such proceedings.
Representing Lisa Hawkins is attorney George M. Bakalar from Kogan & DiSalvo P.A., located in Boynton Beach, Florida. The case is filed under Case Number: 502025CA000348XXXAMB.
