Daniel Hernandez filed a complaint in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, on January 15, 2025, against Fitness International, LLC., doing business as LA Fitness.

The case stems from an incident that occurred on March 21, 2023, when Hernandez was violently assaulted and robbed by three known members of the Latin Kings gang while he was at an LA Fitness location in Lake Worth, Florida. According to the complaint, Hernandez accuses LA Fitness of negligence for failing to provide adequate security measures despite being aware of increased crime rates in the area. The lawsuit alleges that LA Fitness had a non-delegable duty to ensure the safety of its members and prevent foreseeable criminal attacks by implementing reasonable security protocols.

Hernandez's complaint outlines several accusations against LA Fitness. It claims that the gym failed to employ sufficient security personnel or implement effective security measures such as video surveillance and guest monitoring systems. Furthermore, it alleges that LA Fitness did not adequately train its staff to handle potential threats or intervene during criminal activities. The complaint also highlights that LA Fitness allowed individuals with violent tendencies to enter its premises without proper scrutiny.

The plaintiff is seeking damages exceeding $1 million for injuries sustained during the attack, including bodily harm, pain and suffering, medical expenses, loss of income, and diminished quality of life. Hernandez demands a jury trial and requests post-judgment interest along with costs and attorney fees as permitted by law.
