The complaint was lodged in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, on January 8, 2025, naming Publix Super Markets, Inc. as the defendant.
The lawsuit stems from an incident that occurred on July 28, 2023, when Amanda Foley-Roberts visited a Publix store located at 10496 Roosevelt Blvd North in St. Petersburg, Florida. According to the complaint, Foley-Roberts was a business invitee at the supermarket when she slipped on a liquid substance present on the floor of one of the aisles. The plaintiff asserts that Publix had a duty to maintain safe premises for its customers and failed to do so by not inspecting or adequately maintaining its floors and walkways.
Foley-Roberts' legal representation argues that Publix's negligence led directly to her injuries. The complaint outlines several alleged failures by Publix, including inadequate inspection and maintenance of store aisles, failure to warn customers about potential hazards like wet floors, and insufficient employee training regarding safety protocols. "The Defendant negligently failed to inspect or adequately inspect the aisles and walkways," states the complaint, emphasizing that these oversights resulted in dangerous conditions that were either known or should have been known by Publix employees.
As a result of this alleged negligence, Foley-Roberts claims she sustained physical injuries requiring medical treatment and has suffered both physical and mental pain. She also alleges permanent injury affecting her ability to enjoy life and perform daily activities. Consequently, Foley-Roberts is seeking damages exceeding $50,001 along with a jury trial to resolve all triable issues.
