In a dramatic turn of events, a Florida resident has taken legal action against two major corporations over a defective product that allegedly caused severe injuries and property damage. On December 31, 2024, Kyla Hall filed a complaint in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, against The TJX Companies, Inc., and Tekno Products Inc.
The lawsuit stems from an incident involving a Power Pro Transparent Massager purchased by Hall on December 23, 2021, from a Marshalls store operated by The TJX Companies. According to the complaint, while charging the massager on August 7, 2023, it caught fire at Hall's residence. This unexpected malfunction resulted in significant injuries and property damage for Hall. The plaintiff alleges that Tekno Products Inc., responsible for designing and manufacturing the massage gun, failed to ensure its safety before it reached consumers like her.
Hall's legal team argues that both companies were negligent in their duties to provide safe products to consumers. "This Defendant knew or should have known that the subject product was not properly designed," reads part of the complaint against Tekno Products Inc. The allegations extend to include failure to provide adequate warnings about potential risks associated with using the massager.
The plaintiff is seeking damages exceeding $50,000 from both defendants. She accuses them of negligence and strict liability for distributing and selling a defective product without proper safety measures or warnings. In addition to financial compensation for medical expenses and loss of income due to injuries sustained from the incident, Hall demands accountability from these corporations for what she perceives as disregard for consumer safety.
