A Pinellas County resident has taken legal action against a national retail giant following an incident that left her injured. Janet Gardner filed a complaint on December 17, 2024, in the Circuit Court for the Sixth Judicial Circuit in Pinellas County, Florida, against Home Depot U.S.A. Inc., seeking damages exceeding $50,000.
The case revolves around an incident that occurred on July 28, 2028, at a Home Depot store located at 10689 Ulmerton Road in Largo, Florida. According to the complaint, Gardner was loading items into her vehicle when she tripped over tree branches scattered across the parking lot's uneven surface. The lawsuit alleges that Home Depot failed to maintain the parking lot in a safe condition and neglected to warn customers of potential hazards. Gardner's legal team argues that Home Depot had a duty to ensure the safety of its premises by removing debris and warning patrons of any latent dangers.
Gardner claims that as a result of Home Depot's negligence, she suffered permanent personal injuries and continues to endure pain and suffering. The complaint outlines various damages including mental anguish, physical limitations, decreased enjoyment of life, loss of earnings, and medical expenses related to her injuries. The plaintiff asserts that these damages were directly caused by Home Depot's breach of duty in maintaining their property.
The lawsuit accuses Home Depot of failing to exercise reasonable care in keeping their parking lot free from hazards such as tree branches and other debris. Gardner's attorneys argue that these conditions posed concealed dangers which should have been known to the defendant but were not apparent to Gardner at the time of her injury. They contend that Home Depot did not provide adequate warnings about these risks.
In seeking judgment against Home Depot U.S.A. Inc., Gardner is requesting compensation for all damages permitted under Florida law along with costs associated with bringing forth this legal action. Additionally, she demands interest on any awarded sums both before and after judgment is rendered.
Representing Janet Gardner are attorneys John C. Distasio and Chris Limberopoulos from The Florida Law Group based in Tampa, Florida. The case is identified by Case Number: 24-005524-CI and will be heard in front of judges within the Sixth Judicial Circuit Court for Pinellas County.
