Plaintiff alleges negligence by home improvement giant over faulty rental equipment

A Florida resident has filed a lawsuit against a major home improvement retailer, alleging negligence that resulted in significant personal injury. John Horak II initiated the complaint against Home Depot U.S.A., Inc. in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, on November 11, 2024.

The case stems from an incident on May 18, 2024, when Horak rented a trailer with a ramp from Home Depot's Largo location. According to the complaint, while unloading personal items from the trailer, Horak stepped onto the ramp and it collapsed beneath him. This sudden failure caused his foot to become trapped and led to a fall that resulted in severe injuries. The plaintiff claims that Home Depot failed in its duty to provide equipment that was safe and properly maintained.

Horak's legal team outlines several allegations of negligence against Home Depot. They argue that the company did not maintain or inspect the trailer adequately before renting it out. Specifically, they accuse Home Depot of failing to ensure the trailer was in good working order and not warning Horak about its deteriorated condition. Furthermore, they claim that Home Depot neglected to adhere to industry standards for equipment maintenance and failed to train their employees properly regarding safety procedures.

As a result of these alleged oversights, Horak suffered permanent bodily injuries including pain and suffering, disability, disfigurement, mental anguish, and loss of enjoyment of life. He is seeking damages exceeding $50,000 for these injuries as well as compensation for medical expenses and lost earnings due to his inability to work following the accident.

Representing John Horak II is attorney Michael C. Bird from Morgan & Morgan Tampa P.A., who has demanded a jury trial for this case. The presiding judge is yet unnamed under Case Number 24-004950-CI.
