A lawsuit has been filed involving a serious vehicular accident that left the plaintiff with significant injuries and damages. On October 25, 2024, Jose Malave initiated legal proceedings in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, against Krystina Zeigler and Preston Parker. The case revolves around an accident that occurred on February 3, 2024, which Malave claims was caused by Parker's negligent driving.

According to the complaint, Jose Malave was driving his 2019 Volkswagen when it was struck from behind by a 2020 Nissan operated by Preston Parker. The incident took place at approximately 6:40 p.m. near Hagen Ranch Road and Livorno Street in Palm Beach County. Malave alleges that Parker was operating the vehicle without headlights or taillights during nighttime conditions, leading to the collision. The Nissan involved in the crash is owned by Krystina Zeigler, who is also named as a defendant due to her ownership of the vehicle.

Malave asserts that as a direct result of Parker's negligence, he sustained permanent bodily injuries and endured significant pain and suffering. The complaint details various losses suffered by Malave including disability, disfigurement, mental anguish, loss of enjoyment of life, medical expenses, lost earnings, and aggravation of pre-existing conditions. These damages are claimed to be either permanent or ongoing.

The lawsuit seeks judgment for damages exceeding $50,000 exclusive of court costs and interest against both defendants. Under Florida's Dangerous Instrumentality Law, Zeigler is alleged to bear vicarious liability for allowing Parker to use her vehicle. The plaintiff demands compensation for all legally permissible damages along with any additional relief deemed appropriate by the court.

Representing Jose Malave are attorneys Peter J. Somera Jr., Esq., and Paul M. Silva M.D., Esq., from Somera & Silva LLP based in Boca Raton, Florida. The case has been assigned Case Number: 502024CA010250XXXAMB.
