A Palm Beach County resident has filed a lawsuit claiming negligence and strict liability against two companies for injuries sustained due to a defective product. Daniel El Sayed filed the complaint in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, on October 25, 2024, against Koda Enterprises Group, LLC and Dutton-Lainson Company.
The case revolves around an incident that occurred on January 31, 2023, when El Sayed was securing his vessel using a trailer winch manufactured by Dutton-Lainson and distributed by Koda Enterprises. According to the complaint, while El Sayed was securing his boat at the Lake Worth boat ramp, the ratchet lever of the winch failed, causing the handle to snap back violently and injure his hand. The plaintiff claims that both companies are responsible for manufacturing and distributing a defective product that led to his injury.
El Sayed's lawsuit alleges multiple counts against both defendants, including strict liability and negligence. He asserts that Koda Enterprises is liable for placing a defective trailer into commerce with a faulty winch that failed during normal use. Similarly, Dutton-Lainson is accused of manufacturing a winch with defects that rendered it unreasonably dangerous. The plaintiff contends that both companies failed to warn consumers about potential risks associated with their products.
The legal action seeks damages exceeding $50,000 from each defendant for economic and non-economic losses resulting from the incident. These include compensation for bodily injury, pain and suffering, medical expenses, lost earnings, and diminished earning capacity. Additionally, El Sayed demands pre- and post-judgment interest as well as any other relief deemed appropriate by the court.
