Tenant Accuses Apartment Management Company of Unlawful Debt Collection

A recent court filing has brought to light allegations of unlawful debt collection practices by a prominent apartment management company. The complaint, filed by Miroslav Haralampiev in the County Court of the Sixth Judicial Circuit in Pinellas County, Florida on October 23, 2024, accuses GRPF, LLC, doing business as The Grand Reserve at Park Isle Apartments, of violating consumer protection laws.

Miroslav Haralampiev's lawsuit against GRPF centers around an alleged consumer debt related to an apartment rental account. According to the complaint, GRPF was informed that Haralampiev had filed for bankruptcy and was protected by an automatic stay that prohibited any debt collection efforts. Despite this knowledge, GRPF allegedly attempted to collect the debt from Haralampiev on multiple occasions throughout June and July 2024. The complaint asserts that these actions were not only illegal but also knowingly executed despite Haralampiev being represented by legal counsel concerning the debt.

The lawsuit claims that GRPF's actions violated specific provisions of the Florida Consumer Collection Practices Act (FCCPA), particularly sections 559.72(9) and 559.72(18). These sections prohibit attempting to enforce a non-legitimate debt and communicating with a debtor known to be represented by an attorney without proper consent or conditions being met. "GRPF's efforts reflect their assertion of a legal right which did not exist," states the complaint, highlighting how these attempts were made despite clear evidence of bankruptcy protection and legal representation.

Haralampiev is seeking a jury trial and demands judgment against GRPF for damages including penalties, costs, interest, attorney fees, and injunctive relief as stipulated under Florida Statute 559.77(2). The plaintiff argues that these violations have caused both actual and statutory damages as defined by the relevant statutes.
