Louise Anderson, acting as the legal guardian of her minor child K.A., has filed a lawsuit against COQ Properties LLC, alleging negligence that resulted in serious injury to her daughter. The complaint was lodged on October 22, 2024, in the Circuit Court for the Sixth Judicial Circuit in Pinellas County, Florida. Anderson claims that COQ Properties LLC failed to address hazardous conditions on their rental property, leading to a severe accident involving her child.

The case centers around an incident that occurred on January 27, 2023, at a residential property managed by COQ Properties LLC located at 4155 Whiting Cir. SE in St. Petersburg, Florida. According to the complaint, a dead or dying tree fell on K.A., causing significant injuries. Anderson asserts that COQ Properties had both actual and constructive knowledge of the dangerous condition posed by the tree but neglected to take necessary remedial actions. She cites prior complaints made to the defendant and a Violation Notice issued by St. Petersburg's Code Compliance Assistance Department on December 2, 2022, which specifically highlighted the hazardous nature of the tree and demanded its removal.

The plaintiff argues that COQ Properties LLC breached its duty of care as a landlord by failing to conduct reasonable inspections and repairs on their property. The complaint highlights violations of city codes such as Section 16.40.060.3.1 of the St. Petersburg Code of Ordinances due to neglecting necessary maintenance after storm damage reportedly rendered the tree unsafe months before the incident occurred.

Anderson is seeking damages exceeding $50,000 for her daughter's injuries which include bodily harm, physical pain and suffering, disability, disfigurement, mental anguish, and future medical expenses among others. The lawsuit accuses COQ Properties LLC not only of negligence but also of failing to act upon known hazards despite receiving official notices about code violations.
