A woman has filed a lawsuit against a local business and its manager, alleging negligence after she suffered injuries from a fall on the premises. Elizabeth Cheeseman initiated the complaint in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, on October 25, 2024, naming MMG Palm Harbor LLC, doing business as The Lucky Dill, and an individual referred to as Jane Doe as defendants.

The lawsuit arises from an incident that occurred on October 18, 2023. According to the complaint, Cheeseman was visiting The Lucky Dill restaurant located at 33180 US Hwy 19 N in Palm Harbor when she tripped and fell due to wet and slippery stairs. Cheeseman claims that both MMG Palm Harbor LLC and Jane Doe were negligent in maintaining safe conditions on the premises. The complaint outlines several allegations against the defendants including failure to maintain walkways properly, creating hazardous conditions for patrons like Cheeseman, failing to inspect or warn about dangerous conditions, and not correcting known hazards in a timely manner.

Cheeseman argues that these alleged failures directly resulted in her fall and subsequent injuries. She reports suffering serious bodily harm which includes pain and suffering, disability, scarring, disfigurement, mental anguish, loss of enjoyment of life, medical expenses for treatment and care, as well as aggravation of pre-existing conditions. These injuries are described as either permanent or ongoing.

In her legal filing, Cheeseman is seeking damages exceeding $50,000 from both defendants. She demands judgment for damages against MMG Palm Harbor LLC d/b/a The Lucky Dill and Jane Doe separately. Additionally, she requests compensation for court costs associated with this action and a trial by jury for all issues deemed triable.

The case is being handled by attorney Keven Leveille from Morgan & Morgan Tampa P.A., who filed the complaint electronically with Ken Burke's office at the Clerk of the Circuit Court in Pinellas County. The case number assigned is 24-004682-CI.
