Resident Alleges Negligence Against Apartment Complex Owners Over Fall Incident

A resident of a Boca Raton apartment complex has filed a lawsuit claiming negligence after suffering injuries from a fall on the premises. Natale Zanghi, the plaintiff, lodged the complaint in the Circuit Court of Palm Beach County, Florida, on October 10, 2024, against KMF X Boca Manor, LLC and Klingbeil Capital Management, LTD.

The case revolves around an incident that occurred on July 29, 2023. According to the complaint, Zanghi was living at 2500 Boca on Federal Apartments—commonly known as Boca Manor—when he fell due to a defective staircase. The lawsuit claims that both defendants were responsible for maintaining the property and failed in their duty to ensure it was safe for residents. Zanghi alleges that the stairwell leading from the second floor to common areas lacked a slip-resistant covering, which contributed to his fall. The plaintiff accuses KMF X Boca Manor, LLC of negligence for not inspecting or repairing the hazardous conditions despite being aware of them. Similarly, Klingbeil Capital Management is accused of failing to manage and maintain safe conditions as they were responsible for property management at the time.

Zanghi's legal team argues that both companies breached their duty of care by not warning residents about dangerous conditions and failing to implement adequate safety measures. The complaint states: "Defendants knew or should have known about these unsafe conditions but did nothing to correct them." As a result of this alleged negligence, Zanghi claims he suffered severe physical injuries leading to pain and suffering, mental anguish, loss of wages, and medical expenses.

The plaintiff seeks compensatory damages exceeding $50,000 for these losses and demands a jury trial. He asserts that these damages are necessary due to permanent or ongoing impacts from his injuries.
