A Palm Beach County resident has filed a lawsuit against a local business, alleging negligence that resulted in severe injuries. Lucille Wagner filed the complaint on September 23, 2024, in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, against Urban Farm Mart, Inc.
The case revolves around an incident that occurred on September 14, 2023. On this date, Wagner was visiting Urban Farm Mart's premises located at 13863 S. Military Trail in Delray Beach as a guest or invitee when she tripped and fell due to what she claims was defective and improperly maintained asphalt in the parking area. According to the complaint, this hazardous condition led to significant injuries for Wagner. The plaintiff argues that Urban Farm Mart had either actual or constructive notice of the dangerous condition but failed to address it adequately.
Wagner's legal team asserts that Urban Farm Mart breached its duty of care by not maintaining a safe environment and failing to warn visitors about latent dangers. The complaint details several specific allegations against the defendant: failing to maintain the premises safely, not training employees adequately to identify and repair hazards, neglecting to restrict access to dangerous areas, and not warning Wagner about existing dangers. As a result of her fall, Wagner claims she has suffered from pain and suffering, disability, disfigurement, mental anguish, loss of enjoyment of life, medical expenses for hospitalization and treatment, loss of earnings and earning capacity in the future, and aggravation of any pre-existing conditions. She states these damages are either permanent or ongoing.
Wagner is seeking judgment against Urban Farm Mart for damages exceeding $50,000 plus costs associated with her lawsuit. She also demands a jury trial for all issues triable by right.
