Homeowner Sues Local HOA Over Slip-and-Fall Incident

A Palm Beach County resident has filed a lawsuit against a local homeowners association, alleging negligence after a slip-and-fall incident. Dolories Wright lodged the complaint in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, on September 20, 2024, naming Palm Breezes Homeowners Association, Inc. as the defendant.

According to the court documents, Wright claims that on August 22, 2024, she was lawfully on the premises of Palm Breezes Club located at 6131 Palm Harbor Drive in Lantana, Florida. The complaint states that Wright slipped and fell due to water on one of the walkways leading to the pool area. The plaintiff asserts that Palm Breezes Homeowners Association had actual knowledge of this hazardous condition or should have known about it through reasonable care.

Wright alleges that the homeowners association failed in its duty to maintain safe conditions for its residents and guests. "The Defendant breached its duty to Plaintiff by negligently creating and/or allowing a hazardous condition to exist on its premises," reads one part of the complaint. The document further details how the association allegedly neglected to inspect or adequately maintain the premises and failed to warn Wright about potential dangers.

As a result of this incident, Wright claims she suffered significant injuries including permanent bodily harm, pain and suffering both physically and mentally, disability, physical impairment, disfigurement, mental anguish, inconvenience, loss of capacity for enjoyment of life, and medical expenses. These injuries are described as either permanent or continuing in nature.

In her lawsuit, Wright is seeking damages exceeding $50,000 along with interest and costs. She also demands any other relief deemed just and proper by the court. Additionally, Wright has requested a jury trial for all triable issues related to this case.

Representing Dolories Wright is attorney Marius Boeru from Morgan & Morgan P.A., based in West Palm Beach. The case will be presided over by judges from the Circuit Court of the 15th Judicial Circuit under Case Number 502024CA009048XXXAMB Div: AF.
