Resident Sues Property Management Company Over Negligence Leading to Severe Injuries

A recent court filing reveals a dramatic legal battle over alleged negligence at a residential apartment community. On September 16, 2024, Stephanie Frances Smith filed a complaint in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida against PRG Real Estate Management, Inc., accusing the company of failing to maintain safe premises.

According to the complaint, Smith was an invitee on PRG Real Estate Management's property located at 3500 E Sandpiper Dr, Boynton Beach, on April 30, 2024. During her visit, she tripped and fell due to an unsafe sidewalk. The lawsuit alleges that PRG Real Estate Management neglected its duty to provide a reasonably safe environment for its residents and visitors. "The Defendant owed to its invitees...a duty to provide a reasonably safe environment," states the complaint. Smith contends that the company failed in multiple ways: by not maintaining the sidewalk properly, not warning about dangerous conditions, and not placing necessary safety signs or barricades.

Smith's injuries from the fall were severe and have had lasting impacts on her life. She claims to have suffered "severe, grievous and permanent injuries," including physical and mental pain, disability, disfigurement, loss of enjoyment of life, and impairment of earning capacity. The complaint further details that these injuries have led to significant medical expenses and will continue to affect her in the future.

In seeking justice, Smith is demanding judgment for damages exceeding $75,000 along with costs and interest from PRG Real Estate Management. She is also requesting any other relief deemed appropriate by the court. Additionally, Smith has demanded a jury trial for all issues so triable as a matter of right.
