A woman has filed a lawsuit against three companies, alleging negligence after she tripped and fell in a shopping plaza. Rebecca Berardi filed the complaint in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, on August 28, 2024, naming Regency Centers, L.P., Divisions, Inc., and Publix Super Markets, Inc. as defendants.
According to the complaint, Berardi was walking towards the entrance of a Publix Supermarket located at 10913 North Military Trail in Palm Beach Gardens on November 24, 2021. She claims she tripped over landscaping debris that created a dangerous condition on the premises. The fall resulted in serious bodily injuries for which she is seeking compensation.
The plaintiff alleges that Regency Centers, L.P., owned and managed the commercial shopping plaza where the incident occurred. She asserts that they had a legal duty to maintain the premises safely and to warn her of any dangerous conditions. "Defendant breached their duty by failing to exercise reasonable care with respect to maintenance," states Berardi in her complaint. She further accuses them of failing to conduct reasonable inspections and not adequately training their employees to handle such situations.
Similarly, Berardi holds Divisions, Inc., responsible for maintaining and managing the shopping plaza. She argues that they too failed in their duty of care by not keeping the premises free from hazardous conditions like those described. "Defendant's negligence directly led to my injuries," she contends.
Publix Super Markets, Inc., is also named as a defendant for its role in managing and controlling part of the shopping plaza where Berardi fell. The plaintiff claims that Publix failed to warn her about the dangerous condition and did not take necessary precautions to prevent such incidents. "Publix's negligence caused me severe pain and suffering," she alleges.
Berardi is seeking judgments against all three defendants for amounts exceeding $50,000 each. She is asking for compensation for medical expenses, loss of income, physical handicap, disfigurement, mental anguish, and other damages resulting from her injuries.
