Nursing Home Faces Lawsuit Over Alleged Neglect Leading to Resident's Death

A lawsuit has been filed against a Florida nursing home, alleging severe neglect and mistreatment of an elderly resident that led to her death. The complaint was lodged by Susan Leff, representing the estate of Marilyn Leff, in the Circuit Court of the Sixth Judicial Circuit in Pinellas County on August 27, 2024, targeting Menorah Manor, Inc.

According to the court documents, Marilyn Leff was a 94-year-old resident at Menorah Manor from October 3, 2008, until her death on April 3, 2024. Susan Leff claims that during this period, Menorah Manor failed to provide adequate care and protection for her mother. The lawsuit accuses the nursing home of multiple violations under Florida Statutes Chapter 400 and alleges that these failures resulted in severe health deterioration for Marilyn Leff. "At all material times, MENORAH MANOR was required to assess all residents to protect them from harm," states the complaint.

The allegations are extensive and include failure to prevent pressure sores, weight loss, infections, falls, improper transfers resulting in broken bones, and overall inadequate supervision and care. The complaint asserts that Menorah Manor did not adhere to its own policies and procedures designed to ensure resident safety. "MENORAH MANOR acknowledged that the safety of its residents was its 'highest priority,'" yet allegedly failed to live up to this standard.

Susan Leff is seeking damages exceeding $50,000 for negligence and wrongful death. She argues that Menorah Manor's actions directly led to her mother's suffering and eventual death. The plaintiff requests a jury trial and aims for compensation covering damages authorized under the Florida Wrongful Death Act as well as costs related to the lawsuit.
