Homeowner Alleges Local Restoration Company Breached Contract Over Defective Work

A Pinellas County homeowner is suing a local restoration company for failing to complete contracted repair and remodeling work on his property. Ankur Sarup filed the complaint against Ally Restorations, LLC in the Circuit Court of the Sixth Judicial Circuit in and for Pinellas County, Florida, on August 23, 2024.

According to the court documents, Sarup owns a property located at 2833 12 Avenue North, St. Petersburg, Florida. He entered into a contract with Ally Restorations to perform mitigation, repair, and remodeling work on his home. The agreement stipulated that Ally Restorations would manage the construction process and ensure all work complied with the Florida Building Code (FBC). However, Sarup alleges that Ally Restorations failed to complete the project as per the contract terms.

The lawsuit details numerous construction defects discovered after Ally Restorations began work on the property. These include failures such as not installing a vapor barrier, improper slope of PVC drains in the crawlspace, leaks from the bathtub, wet subflooring, condensation issues with duct supply boxes, sloping defects in flooring, missing base cabinets in both kitchen and master bathroom, unfinished plumbing work, and missing baseboards and countertops. Specific sections of the FBC cited in the complaint include Sections 101.2 and 3005.3 which pertain to structural strength and proper drainage system installation.

Sarup accuses Ally Restorations of negligence for not supervising their employees or subcontractors adequately. The plaintiff asserts that these failures resulted in significant damage to his property requiring extensive repairs. The complaint further claims that Ally Restorations violated Section 553.84 of Florida Statutes by not adhering to building codes during their work on Sarup's home.

In addition to seeking damages exceeding $50,000 exclusive of interest and costs, Sarup demands compensation for all losses incurred due to Ally Restoration’s alleged breach of contract and negligence. The plaintiff also requests prejudgment interest and any other relief deemed appropriate by the court.
