A shocking incident involving a dog attack has led to a lawsuit seeking damages exceeding $50,000. James Fullerton filed the complaint against Robert Taylor in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida, on August 19, 2024.
According to the complaint, Fullerton alleges that he was invited to Taylor's property on October 3, 2023. On that day, Fullerton was bitten in the face by Taylor's dog, Pearl, an adult white Pitbull mix. The attack occurred at Taylor's residence located at 333 SW 27th Ave, Delray Beach, Florida. As a result of the bite, Fullerton claims to have incurred significant medical expenses and sustained permanent scarring.
The legal action is grounded in Florida Statute Sections § 767.04, which holds dog owners strictly liable for injuries caused by their pets regardless of whether the owner was negligent or if the dog had previously shown signs of aggression. Fullerton asserts that Taylor is responsible for his injuries under this statute. The plaintiff details various forms of suffering due to the incident including bodily harm, permanent injury and future impairment, scarring and disfigurement, past and future pain and suffering, mental anguish, emotional distress, and loss of capacity for enjoyment of life.
Fullerton seeks a judgment from the court for an amount to be determined at trial along with interest and costs. He also demands a jury trial on all issues raised before a jury.
