Minor Sues Golf Cart Company Over Severe Injuries

A minor's life was tragically altered due to a golf cart accident, leading to a lawsuit seeking justice and compensation. On August 19, 2024, Kristen Alagna filed a complaint in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, against Water Pontoon LLC, Blue Pointe Partners LLC, and Julianne Clark.

The incident occurred on October 28, 2023. According to the court filing, Julianne Clark was operating a golf cart owned or operated by Water Pontoon LLC while employed by Blue Pointe Partners LLC. The plaintiff alleges that Clark's negligence led to severe injuries for Luca Alagna, a minor. Specifically, the complaint states that Clark failed to operate the golf cart safely and did not ensure that all riders were properly restrained or accompanied by adult supervision. As a result of this alleged negligence, Luca fell out of the cart and was run over by one of its tires.

The complaint outlines several accusations against Julianne Clark and her employers. It claims that Clark owed a duty to operate the golf cart prudently but failed in this responsibility. The plaintiff asserts that both Water Pontoon LLC and Blue Pointe Partners LLC are vicariously liable for Clark's actions since she was acting within the scope of her employment at the time of the incident.

The injuries sustained by Luca Alagna are described as severe and permanent. The plaintiff lists numerous damages including bodily injuries, pain and suffering, disability, disfigurement, mental anguish, scarring, loss of capacity for enjoyment of life, medical treatment costs (both current and future), and aggravation of any pre-existing conditions. These losses are claimed to be either permanent or continuing.

In light of these allegations and injuries, Kristen Alagna is seeking judgment against Julianne Clark, Blue Pointe Partners LLC, and Water Pontoon LLC for damages exceeding $50,000. Additionally, the plaintiff requests taxable costs and pre-judgment interest along with any other relief deemed just and proper by the court. A trial by jury has also been demanded.
