A local resident is taking legal action against a prominent hotel in Palm Beach County, alleging negligence that led to severe injuries. On August 14, 2024, Jesus R. Rojas filed a complaint in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida, against Shiraz Management, LLC, doing business as Hilton Palm Beach Airport.
According to the complaint, on June 11, 2023, Rojas was lawfully present at the Hilton Palm Beach Airport hotel when he encountered a hazardous condition on an exterior accessible route leading to a boardwalk and jet ski dock. The plaintiff claims that a wooden ramp with deficient surface conditions caused him to fall and sustain serious injuries. The lawsuit details that all conditions precedent to bringing this cause of action have been satisfied.
Rojas alleges that the defendant had several duties: maintaining its premises in a reasonably safe condition; constructing and maintaining accessible routes according to applicable codes and standards; correcting any dangerous conditions known or should have been known through reasonable care; and warning of any dangerous conditions about which they had superior knowledge. The complaint asserts that Hilton Palm Beach Airport breached these duties by failing to construct or maintain accessible routes per applicable standards, allowing a dangerous condition to exist, failing to correct it, and not warning Rojas about it.
As a direct result of this alleged negligence, Rojas claims he suffered extensive damages including bodily injury, pain and suffering, disfigurement, mental anguish, emotional distress, loss of enjoyment of life’s activities, hospitalization expenses, and costs for medical and nursing care. These losses are described as permanent and continuing into the future.
The plaintiff seeks compensatory damages exceeding $50,000 from Shiraz Management LLC d/b/a Hilton Palm Beach Airport. Additionally, he requests coverage for costs associated with the lawsuit and any other relief deemed appropriate by the court. A jury trial has also been demanded.
Representing Jesus R. Rojas are attorneys Mariano Garcia (Florida Bar No.: 31143) and Juan C. Diaz Avila (Florida Bar No.: 91011) from Searcy Denney Scarola Barnhart & Shipley PA.
