A resident of Palm Beach County is seeking justice after a scooter accident allegedly caused by hazardous conditions at a local condominium complex. Milan Pavlik filed a complaint on August 15, 2024, in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, against Flagler Landing Condominium Association, Inc., Triton Property Management, LLC, and Fresh Start BSC, Inc.
According to the complaint, Pavlik was entering the gate at Flagler Landing on May 31, 2024, when his scooter encountered excessive sand and debris on the roadway. This caused his scooter to slide out from under him, resulting in an accident. Pavlik claims that he was given no warning about this hazardous condition. The lawsuit alleges that Flagler Landing Condominium Association failed to maintain a safe environment for its residents and visitors. "Defendant owed a duty to use reasonable and ordinary care to provide a safe environment," states the complaint.
The plaintiff asserts that Flagler Landing breached its duty by not ensuring the roadways were free from excessive sand and debris. Additionally, it is alleged that employees were not properly trained to inspect these areas periodically to ensure safety. As a result of this negligence, Pavlik suffered significant injuries including bodily harm, pain and suffering, disability, disfigurement, mental anguish, loss of capacity for enjoyment of life, medical expenses, loss of earnings and aggravation of pre-existing conditions.
Pavlik is also suing Triton Property Management LLC for similar reasons. The complaint details how Triton Property Management failed in their duty to maintain safe roadways within the condominium complex. Like Flagler Landing Condominium Association Inc., Triton is accused of failing to train employees adequately and failing to warn guests about existing hazards.
Fresh Start BSC Inc., responsible for maintenance at Flagler Landing's property located at 3900-3960 North Flagler Drive in West Palm Beach is also named as a defendant in this case. The plaintiff claims that Fresh Start BSC Inc.'s negligence contributed significantly to his accident by not keeping the roadways clear of hazardous materials such as sand or debris.
Pavlik seeks judgment for damages exceeding $50k against each defendant along with costs incurred due to this incident. He demands compensation for his physical injuries as well as emotional distress caused by this event which has impacted his quality of life severely.
