In a legal showdown that could have significant implications for business safety standards, Elsa Castro has filed a lawsuit against Bowling Supermarket Inc. in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida. The complaint, lodged on December 29, 2024, accuses the supermarket of negligence leading to a serious injury sustained by Castro at their Belle Glade location.

The plaintiff, Elsa Castro, claims that she was injured on December 29, 2023, due to unsafe conditions at Bowling Supermarket Inc.'s premises located at 1425 S. Main Street, Belle Glade. According to the complaint, Castro was a business invitee when she encountered hazardous conditions on the pedestrian walkway and flooring of the supermarket. The filing alleges these areas were "unsafe, dangerous, improperly designed, improperly constructed, and/or improperly maintained," which led to her injury. Specific accusations include allowing slippery or wet surfaces to persist and failing to mark these hazards with warning signs.

Castro's legal team argues that Bowling Supermarket Inc., as a Florida for-profit corporation responsible for maintaining its property in Palm Beach County, breached its duty of care. The lawsuit states that the supermarket failed in several critical areas: keeping its premises safe; maintaining and inspecting its facilities; implementing proper operational methods; and warning patrons about potential dangers. The complaint highlights that these failures resulted in severe injuries to Castro's head, neck, back, body, and limbs.

The damages sought by Castro exceed $50,000 and are aimed at covering past and future medical expenses as well as compensation for pain and suffering. Additionally, the plaintiff seeks reparations for loss of earnings and earning capacity due to her injuries. This case underscores significant issues regarding premises liability and the responsibilities businesses have towards ensuring customer safety.

Representing Elsa Castro is Todd McPharlin from Coffey McPharlin Trial Law based in Fort Lauderdale. The case is filed under Case Number 502024CA012235XXXAMB.
