Customer Sues Popular Restaurant Over Severe Burns from Hot Tea Incident

A scalding hot tea incident at a popular restaurant has led to a significant legal battle. On August 15, 2024, Jakorya Nunnally filed a complaint in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, against Miller’s Ale House, Inc., and its store manager Kortney Brothers.

The lawsuit stems from an incident on July 22, 2023, when Nunnally visited Miller’s Ale House located at 9800 ALT A1A in Palm Beach Gardens. According to the complaint, Nunnally was served scalding hot tea in a thin plastic cup by an employee of the restaurant. The cup melted, causing the hot tea to spill and result in severe burns and permanent scarring on her right thigh, legs, and abdomen. The plaintiff alleges that both Miller’s Ale House and Kortney Brothers were negligent in their duty to ensure customer safety.

Nunnally's complaint outlines several accusations against the defendants. She claims that Miller’s Ale House failed to provide proper heat-resistant cups for hot beverages and did not adequately warn customers about the potential dangers of using thin plastic cups for hot liquids. The lawsuit also states that the restaurant neglected to inspect or correct this hazardous condition despite knowing—or reasonably should have known—about the risks involved. Furthermore, it is alleged that Kortney Brothers allowed employees to serve hot beverages in unsafe containers, thereby contributing to the dangerous situation.

The plaintiff is seeking damages exceeding $50,000 for bodily injury resulting in pain and suffering, disability, disfigurement, mental anguish, loss of capacity for enjoyment of life, medical expenses, loss of earnings and earning capacity, and aggravation of pre-existing conditions. Nunnally asserts that these losses are either permanent or ongoing and will continue into the future.
