A recent court filing reveals a serious personal injury lawsuit involving a dangerous property condition that has left the plaintiff with severe and permanent injuries. Dorothy Cynthia Tsonas filed the complaint in the Circuit Court of the 6th Judicial Circuit in Pinellas County, Florida, on August 14, 2024, against Steven R. Trimble Jr. and Debbie L. Trimble.
According to the complaint, Tsonas was lawfully present at the property located at 2194 Nimitz Drive, Dunedin, FL on July 26, 2023. The property is owned and maintained by both defendants. While walking towards the front door of the house, Tsonas encountered a raised concrete object on the walkway that caused her to trip and fall. The lawsuit alleges that this hazardous condition resulted from negligence on the part of Steven R. Trimble Jr. and Debbie L. Trimble.
The complaint details how both defendants failed to maintain their property in a reasonably safe condition and neglected to warn visitors about potential dangers. "At all times hereinafter mentioned and at the time of the incident complained of," states the document, "the Defendant... negligently failed to correct or warn of the dangerous condition when [they] either knew or should have known of the danger due to the passage of time." The lawsuit further claims that there were no established procedures for regular inspection of the premises or that any existing procedures were not followed.
As a direct result of this alleged negligence, Tsonas sustained severe injuries affecting her wrist, body, and limbs. She has been rendered "sick, sore, lame and otherwise disabled," according to court documents. These injuries are described as permanent or continuing in nature, causing Tsonas significant pain and suffering as well as loss of enjoyment of life.
The plaintiff is seeking damages exceeding $50,000 from each defendant for medical expenses incurred both past and future, loss of earnings and earning capacity, and extensive medical care required due to her injuries. Additionally, she demands judgment for interest and costs associated with these damages.
