Patient sues Medical Office over Negligence

A routine visit to a medical office turned into a painful ordeal for one woman, who is now seeking justice through the courts. Teresa Kelly has filed a complaint against West Coast Ear, Nose & Throat, Inc. in the Circuit Court of the Sixth Judicial Circuit in and for Pinellas County, Florida on August 12, 2024.

The lawsuit centers around an incident that occurred on June 14, 2023. According to the complaint, Kelly was visiting the premises of West Coast Ear, Nose & Throat, Inc., located at 1330 S. Ft. Harrison in Clearwater, Florida. As she walked through the parking lot, she tripped over an uneven piece of cement and sustained serious injuries. The complaint alleges that the defendant had either actual or constructive knowledge of this hazardous condition but failed to address it.

Kelly's attorney argues that West Coast Ear, Nose & Throat had a non-delegable duty to ensure the safety of its invitees by maintaining their premises in a reasonably safe condition. "The defendant negligently failed to maintain or adequately maintain the premises," reads part of the complaint. It further accuses the medical office of failing to inspect or warn patrons about potential hazards and failing to correct known dangerous conditions.

As a result of this alleged negligence, Kelly claims she suffered various injuries including pain and suffering, disability, disfigurement, permanent scarring, mental anguish, and loss of enjoyment of life. She also cites expenses related to hospitalization and medical care as well as lost earnings and diminished earning capacity.

Kelly is seeking damages exceeding $50,001 along with interest and costs from West Coast Ear, Nose & Throat. She has demanded a trial by jury for all issues so triable.
