Pinellas Resident Sues Popular Restaurant Chain Over Negligence After Fall

A Pinellas County resident has taken legal action against a popular restaurant chain, alleging negligence after a fall on the premises. Christopher W. Robinson filed a complaint in the Circuit Court of the Sixth Judicial Circuit in and for Pinellas County, Florida, on August 8, 2024, against Miller’s Ale House, Inc.

According to the court documents, Robinson claims that he suffered severe injuries after tripping over an uneven mat at the entrance of Miller’s Ale House located at 7695 113th Street in Seminole, Florida. The incident occurred on March 21, 2024. Robinson asserts that there were no warning signs near the hazardous area and that this negligence led to his fall and subsequent injuries.

The lawsuit details that Miller’s Ale House had a duty to maintain its premises in a reasonably safe condition for its invitees and to eliminate hazards or provide adequate warnings about them. Robinson alleges that the restaurant failed in this duty by allowing an unsafe condition—the uneven mat—to exist for an extended period without remedying it or warning patrons. The complaint states: "The dangerous condition of the uneven mat placed inside of the entrance of Miller’s Ale House existed for a sufficient length of time so that Defendant knew or should have known of its existence."

Robinson's injuries from the fall are described as severe and permanent, including significant loss of bodily function and enduring pain and suffering. He also cites humiliation, embarrassment, loss of enjoyment of life, medical expenses, and lost wages as consequences of the incident. As per the complaint: "As a direct and proximate result of Defendant’s breach of duties... Christopher W. Robinson was caused to sustain severe, continuing and permanent injuries."

In his filing, Robinson is seeking damages exceeding $50,000 exclusive of interest and costs. He demands judgment against Miller’s Ale House for these damages along with any further relief deemed appropriate by the court. Additionally, he requests recovery for past and future medical expenses as well as lost wages due to diminished earning capacity resulting from his injuries.

Represented by attorney Byron L. Kennedy III from Tripp Law Firm P.A., Robinson has also included claims for costs under §57.041 Florida Statutes and potential recovery of attorney fees under §768.79 Florida Statutes if an Offer of Judgment or Proposal for Settlement is served.

The case will be presided over by judges from the Sixth Judicial Circuit Court with Case Number 24-003528-CI.
