Customer Sues Convenience Store Chain Over Slip-and-Fall Incident

A recent court filing has brought to light a significant personal injury case involving a major retail corporation. On August 9, 2024, Raimundo Estenoz filed a complaint in the Circuit Court for the Fifteenth Judicial Circuit in Palm Beach County, Florida, against 7-Eleven, Inc., alleging negligence and seeking damages exceeding $50,000.

According to the complaint, Estenoz was visiting a 7-Eleven location at 101 W. Woolbright Rd., Boynton Beach, Florida on August 13, 2023. As he exited his vehicle after 7:30 p.m., he slipped and fell due to what he describes as "a dangerous, defective, and/or unsafe condition" near a gas pump. The hazardous condition allegedly consisted of gasoline, oil, water, grime, grease, dirt or a combination of these substances. Estenoz asserts that this incident resulted in significant personal injuries including pain and suffering, disability, disfigurement, mental anguish, permanent scarring, loss of enjoyment of life, medical expenses and loss of earnings.

The plaintiff contends that 7-Eleven had a non-delegable duty to maintain its premises in a reasonably safe condition but failed to do so. Specifically, the complaint accuses the company of several acts of negligence such as failing to clean or maintain the area around its gas pumps free from hazardous substances and not placing any warning signs or cones to alert customers about potential dangers. Furthermore, it alleges that 7-Eleven did not hire sufficient or appropriate personnel to ensure the safety of its premises nor properly train its employees to prevent such accidents.

Estenoz's legal team argues that these failures directly led to his slip-and-fall accident and subsequent injuries. They are seeking damages exceeding $50,000 along with interest and costs associated with the lawsuit. The plaintiff demands a jury trial for all issues so triable.
