A Massachusetts and Florida resident has filed a lawsuit against a condominium association, alleging negligence after suffering severe injuries from a fall on the property. Mary Ann Ulevich filed the complaint in the Circuit Court of the 6th Judicial Circuit in Pinellas County, Florida, on August 7, 2024, naming Camelot Condominium Owners’ Association, Inc. as the defendant.
According to the complaint, Ulevich was an invitee at Camelot by the Sea, located at 1801 Gulf Way, St. Pete Beach, Florida, on December 23, 2022. While walking near parking space 303 in the parking lot of the premises, she tripped and fell due to an unlevel and cracked section of asphalt and concrete. The plaintiff claims that Camelot Condominium Owners’ Association had a duty to maintain safe conditions for pedestrians but failed to do so.
The lawsuit outlines several accusations against Camelot Condominium Owners’ Association. It asserts that the association knew or should have known about the hazardous condition of the parking lot and failed to take reasonable steps to repair it or warn pedestrians of its dangers. Specifically, Ulevich alleges that Camelot created a dangerous condition by not maintaining or repairing the parking lot adequately and failing to provide sufficient lighting for pedestrians to notice potential hazards. Furthermore, she accuses Camelot of not adhering to applicable building codes and safety regulations.
Ulevich's injuries are described as severe and encompassing pain and suffering, disability, disfigurement, mental anguish, loss of enjoyment of life, medical expenses, loss of earnings capacity, and aggravation of pre-existing conditions. She claims these damages are either permanent or ongoing and will continue to affect her in the future.
In her filing, Ulevich seeks judgment for damages exceeding $50,000 exclusive of costs and interest. She demands compensation for all paid medical expenses along with prejudgment interest at the legal rate. Additionally, she requests court costs and any further relief deemed just by the court.
