A slip-and-fall incident at a major retail store has led to a significant legal battle. Anita Bradley filed a complaint against Wal-Mart Stores East, LP in the Circuit Court for Pinellas County, Florida on August 5, 2024.
According to the court documents, Bradley is seeking damages exceeding $50,000 after she sustained injuries from slipping on water near a water fountain inside a Walmart Supercenter located at 3501 34th St S, St. Petersburg, FL. The incident occurred on May 18, 2024. Bradley claims that as a business invitee, she was owed a duty of care by Walmart to ensure her safety while on their premises.
The complaint details several allegations of negligence against Walmart. It asserts that the company failed to maintain safe conditions by not adequately inspecting or maintaining the flooring where the incident took place. Specifically, it states that Walmart did not properly inspect the area near the water fountain to identify and rectify any slip hazards. Furthermore, it accuses Walmart of failing to warn customers about the dangerous condition of the floor and not following its own corporate policies regarding such hazards.
Bradley’s lawsuit emphasizes that these lapses directly resulted in her slipping and falling, leading to significant injuries. The document lists various forms of suffering she has endured due to this accident: bodily injury, pain and suffering, disability, disfigurement, permanent scarring, mental anguish, loss of enjoyment of life, medical expenses, loss of earnings and earning capacity, and aggravation of pre-existing conditions. These losses are described as either permanent or ongoing.
In light of these grievances, Bradley is seeking compensatory damages exceeding $50,001 plus interest and costs from Walmart. She also demands a jury trial for all triable issues related to this case.
