Customer Sues Retail Giant Over Negligence Leading to Severe Injuries

A routine shopping trip turned into a nightmare for one Florida resident, leading to a lawsuit against a major retail chain. Christopher Harris filed a complaint in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida, on August 9, 2024, against Wal-Mart Stores East, LP and an employee identified as John Doe.

According to the court documents, Harris alleges that on July 14, 2024, he was struck by a large stocking cart operated by John Doe while visiting the Wal-Mart located at 3200 Old Boynton Road in Boynton Beach. The complaint states that Doe was distracted by his cell phone when he rammed the cart into Harris, causing serious and permanent injuries. Harris contends that as a business invitee, Wal-Mart owed him a duty of care to ensure his safety while on their premises.

The plaintiff claims that Wal-Mart breached this duty by allowing hazardous conditions to exist within their store. Specifically, Harris accuses Wal-Mart of failing to properly train and supervise its employees in the safe operation of stocking carts. The complaint also highlights that Wal-Mart did not take adequate steps to warn customers about potential dangers or correct known hazardous conditions.

"Defendant knew or should have known of the existence of the dangerous condition on the Premises and should have taken action to remedy same," states the complaint. It further asserts that such dangerous conditions occurred with regularity and were foreseeable to Wal-Mart.

Harris is seeking damages exceeding $50,000 for pain and suffering, medical expenses, loss of earnings both past and future, and other related costs. He argues that these losses are permanent and continuing in nature.

Represented by Carissa M. Peebles from Morgan & Morgan P.A., Harris demands judgment against both defendants for negligence. The case has been assigned Case Number 502024CA007552XXXAMB Div: AG.
