Shopper Sues Retail Chain Over Negligence Leading to Slip-and-Fall Injury

A slip-and-fall incident at a retail store has led to a lawsuit seeking damages exceeding $50,000. On August 5, 2024, Luz Mery Mejia Hernandez filed a complaint in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, against Ross Dress for Less, Inc.

According to the complaint, on December 9, 2023, Mejia Hernandez was shopping at Ross Dress for Less located at 6308 Lantana Road in Lake Worth when she slipped and fell due to a foreign substance on the floor. The plaintiff alleges that Ross Dress for Less negligently maintained its premises by failing to inspect and rectify hazardous conditions or warn customers about them. "The negligent condition was known to the Defendant or had existed for a sufficient length of time that the Defendant should have known of it," states the complaint.

Mejia Hernandez asserts that she was a business invitee and that Ross Dress for Less had a duty to ensure her safety while she was on their property. The lawsuit claims that Ross breached this duty by not maintaining safe walkways and aisles, failing to correct dangerous conditions promptly, and not providing adequate warnings about potential hazards. Furthermore, the plaintiff accuses Ross of gross negligence and reckless conduct through its employees' actions.

As a result of the fall, Mejia Hernandez sustained injuries described as permanent and continuing in nature. She has experienced physical pain, mental anguish, incurred medical expenses, suffered an aggravation of pre-existing conditions, and lost wages due to impaired working ability. The plaintiff seeks compensation for these damages along with future medical costs related to her injuries.

Represented by attorney Maria Abellon from Abellon P.A., Mejia Hernandez demands a jury trial and requests judgment against Ross Dress for Less in an amount exceeding $50,000 plus costs associated with the legal action.
