A medical malpractice lawsuit has been filed against a prominent podiatrist and his practice, alleging severe negligence in the treatment of a patient's Achilles tendon injury. The complaint was lodged by Alexander Terry in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida, on July 23, 2024, naming Dr. Daniel Elgut and South Florida Foot and Ankle Centers, P.A. as defendants.
According to the complaint, Alexander Terry began experiencing complications after undergoing surgery performed by Dr. Daniel Elgut on May 17, 2021. Terry initially sought treatment for right posterior heel pain from another physician at South Florida Foot and Ankle Centers on April 13, 2021. After conservative treatments failed to alleviate his symptoms, an MRI revealed significant issues with his Achilles tendon. Following this diagnosis, Dr. Elgut recommended surgical intervention without offering alternative treatment options.
Terry underwent surgery on May 17, 2021, but soon began experiencing tingling and numbness in his toes—a condition that persisted through multiple follow-up visits until November 2, 2021. Despite these complaints, physical therapy was not recommended until October 18, 2021. Subsequent diagnostic tests conducted by other medical professionals revealed that the initial surgery had failed and that additional surgeries were necessary to address ongoing issues.
The plaintiff alleges that Dr. Elgut's failure to provide timely and appropriate care resulted in permanent injuries including disfigurement and loss of enjoyment of life. The lawsuit accuses Dr. Elgut of failing to obtain proper informed consent from Terry by not discussing alternative treatments or potential risks associated with the surgery.
Additionally, the complaint holds South Florida Foot and Ankle Centers vicariously liable for Dr. Elgut’s actions since he was acting within the scope of his employment at the time of treatment. The plaintiff seeks compensatory damages exceeding $50,000 for medical expenses, pain and suffering, disfigurement, loss of enjoyment of life, and aggravation of pre-existing conditions.
