Resident Sues Apartment Complex Over Negligence Leading to Severe Injuries

A resident of a St. Petersburg apartment complex has filed a lawsuit against the property management company, alleging negligence that led to severe injuries. The complaint was filed by Mikayla Miedzianowski in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, on July 25, 2024, against AVBH Bel Air LLC, doing business as Marisol Vista Apartments.

According to the court documents, Miedzianowski claims that on April 13, 2024, she tripped and fell over a cement slab negligently left on a poorly illuminated walkway at Marisol Vista Apartments. The plaintiff asserts that the defendant failed to maintain safe conditions by not properly illuminating walkways and leaving debris and construction materials around the premises. "Defendant breached their duty by failing to provide proper lighting and failing to maintain the grounds outside of Plaintiff's apartment," reads the complaint.

Miedzianowski argues that this negligence resulted in serious and permanent injuries causing her pain and suffering, disability, mental anguish, loss of capacity for enjoyment of life, and substantial medical expenses. She alleges that these damages are either permanent or will continue into the future. The lawsuit states that Marisol Vista Apartments had a duty to keep its premises safe for residents but failed to do so.

The plaintiff is seeking judgment against Marisol Vista Apartments for monetary damages exceeding $50,000.00. This includes compensation for bodily injuries, pain and suffering, disability, mental anguish, loss of enjoyment of life, and medical expenses. Additionally, Miedzianowski demands a trial by jury.
