Plaintiff sues Property Management Companies over Negligence

A Palm Beach County resident has filed a lawsuit against two companies, alleging negligence that led to a serious injury. Joyce Lazarowitz filed the complaint in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, on July 10, 2024, naming Cross County Owner LLC and Madison Properties USA LLC as defendants.

According to the court documents, Lazarowitz claims she was injured on February 3, 2024, while visiting Cross County Plaza, a strip mall located at 4340 Okeechobee Boulevard and/or 1870 N. Military Trail in West Palm Beach. The plaintiff alleges that she tripped and fell due to an uneven asphalt walking surface joining a sidewalk ramp that failed to conform to applicable codes, regulations, and industry standards. This hazardous condition was allegedly not warned about or remedied by the defendants.

Lazarowitz asserts that both Cross County Owner LLC and Madison Properties USA LLC had actual or constructive knowledge of the hazardous condition through reasonable inspection but failed to take appropriate action. "Defendants owed invitees like Joyce Lazarowitz a duty to exercise reasonable care to maintain their premises free of hazards," reads the complaint. It further states that the defendants failed to adequately warn invitees of the dangerous condition or timely remedy it.

The plaintiff is seeking compensatory damages for bodily injury resulting in pain and suffering, disability, disfigurement, mental anguish, loss of capacity for enjoyment of life, inconvenience, lost wages and earning capacity, medical expenses for care and treatment, and aggravation of a previously existing condition. These injuries are described as permanent and ongoing.
