Resident Sues Condominium Association Over Negligence Leading to Severe Injuries

A Palm Beach County resident is taking legal action against her condominium association, alleging negligence that led to severe injuries. Bessie Zurawin filed a complaint on July 8, 2024, in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, against Emerald Pointe Community Association, Inc.

According to the complaint, on March 18, 2024, Ms. Zurawin was lawfully present at her residence located at 7913 Lake Sands Drive in Delray Beach when she tripped and fell due to hazardous conditions on the property’s walkways. The plaintiff claims that the condominium association failed to maintain safe pathways and neglected their duty to warn residents of potential dangers. Specifically, the lawsuit states that the walkways were uneven, chipped, cracked, and had abrupt changes in elevation.

Ms. Zurawin's attorney argues that Emerald Pointe Community Association had a responsibility to ensure a reasonably safe environment for its residents. The complaint lists several instances of alleged negligence by the defendant: failing to maintain or adequately maintain the walkways; allowing sections of the walkway to be misaligned or cracked; not warning residents about these dangerous conditions; and failing to inspect or correct these hazards in a timely manner.

The plaintiff asserts that as a direct result of this negligence, she suffered significant injuries including pain and suffering, disability, disfigurement, permanent scarring, mental anguish, loss of enjoyment of life, medical expenses, and loss of earnings. These injuries are described as either permanent or continuing in nature.

Ms. Zurawin is seeking damages exceeding $50,000 plus interest and costs from Emerald Pointe Community Association. She has also demanded a jury trial for all issues so triable.
