Local Resident Sues Multiple Businesses Over Negligence Leading to Injuries

A Palm Beach County resident has filed a lawsuit against multiple businesses, alleging negligence that led to her suffering serious injuries. On June 28, 2024, Witney Bartley filed a complaint in the Circuit Court of the 15th Judicial Circuit in and for Palm Beach County, Florida, against J Jacobs Holdings, LLC; Bridgestone Retail Operations LLC doing business as Tires Plus; Swordfish Real Estate, LLC; and Circle K Stores, Inc.

According to the court documents, Bartley claims that on June 5, 2023, she was driving through a parking lot owned by J Jacobs Holdings at 2930 10th Ave N in Palm Springs when her car hit a pothole. The impact allegedly caused her to suffer "serious and permanent injuries." Bartley asserts that J Jacobs Holdings had a duty to maintain the parking lot in a safe condition but failed to do so. She alleges that the company allowed dangerous holes to remain unrepaired and did not warn visitors about these hazards. "The Defendant created and/or allowed to remain unrepaired big and dangerous holes on the ground of the parking lot," reads part of the complaint.

Bartley is seeking damages exceeding $50,000 from each defendant for bodily injuries, pain and suffering, disability, property damage, mental anguish, medical expenses, loss of income, and loss of earning capacity. She claims these losses are either permanent or continuing and will affect her future quality of life.

In addition to J Jacobs Holdings' alleged negligence regarding their parking lot's maintenance, Bartley also accuses Bridgestone Retail Operations (Tires Plus), Swordfish Real Estate LLC, and Circle K Stores Inc. of similar negligence related to their respective properties. Each count details how these companies failed in their duty to ensure safe premises for their patrons. For instance, Bartley alleges that Tires Plus operated at the same location where she encountered the pothole and thus shares responsibility for maintaining safe conditions.
