Boca Raton Resident Sues Real Estate Trust Over Negligence Leading to Severe Injuries

A Boca Raton resident has filed a lawsuit against a prominent real estate investment trust, alleging negligence after a slip-and-fall incident left him with permanent injuries. Michael Cesaro lodged the complaint against RREEF America REIT II Corp. J in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida, on June 19, 2024.

According to the complaint, Cesaro visited the defendant's property at 9846 Glades Rd, Boca Raton, FL, on March 3, 2024. During his visit as a business invitee to the premises which houses a Publix Supermarket, Cesaro slipped and fell on a wet and negligently maintained painted curb linking the parking lot to the supermarket. The plaintiff claims that this incident resulted in severe and permanent injuries.

The lawsuit details several accusations against RREEF America REIT II Corp. J., including failure to maintain safe premises and neglecting to warn visitors about potential hazards. "Defendant had actual or constructive notice of the rain that is a regularly occurring condition," states the complaint. It further alleges that RREEF America failed in multiple ways: not maintaining or inspecting the premises adequately, not warning about potential dangers, failing to correct known hazardous conditions, and inadequately training their staff for such inspections.

Cesaro's legal team argues that these lapses constitute negligence under Florida law. The plaintiff asserts that as a direct result of this negligence, he suffered bodily injury leading to pain and suffering, disability, disfigurement, significant scarring, mental anguish, loss of enjoyment of life, medical expenses, loss of earnings capacity, and aggravation of pre-existing conditions. These losses are described as either permanent or continuing into the future.

In seeking relief from the court, Cesaro demands damages exceeding $50,000 plus interest and costs. He also requests a jury trial for all triable issues related to this case.
