A slip-and-fall incident at a geriatric care facility has led to a lawsuit seeking damages exceeding $50,000. Lucas Day Brown filed the complaint against Lourdes-Noreen McKeen Residence and Lourdes-Noreen McKeen Residence for Geriatric Care, Inc. in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida on June 17, 2024.

According to the complaint, on March 15, 2023, Lucas Day Brown was visiting his mother at the Lourdes-Noreen McKeen Residence located at 315 S Flagler Dr., West Palm Beach. During his visit, Brown allegedly slipped and fell in a hallway due to water pooled on the floor. The plaintiff claims that the defendants failed to maintain a safe environment for their business invitees by not addressing or warning about the hazardous condition.

The lawsuit accuses both entities of negligence. It states that they "owed to its business invitees a duty to provide a reasonably safe environment" but breached this duty by failing to maintain the premises properly. Specific allegations include not keeping the floor dry, not warning visitors of potential dangers, and neglecting to place signs or barricades alerting people about the wet floor. The complaint also asserts that these conditions had existed long enough for the defendants to be aware and remedy them.

As a result of this alleged negligence, Brown claims he suffered severe bodily injuries that are permanent within a reasonable degree of medical probability. These injuries have led to significant pain and suffering, disability, aggravation of pre-existing conditions, scarring or disfigurement, physical impairment, inconvenience, loss of enjoyment of life, medical expenses including hospitalization and nursing care, as well as loss of earnings and future earning capacity.

The plaintiff is seeking judgment for damages along with costs and interest from both defendants. He is also demanding a jury trial for all issues triable as a matter of right.

Representing Lucas Day Brown is Brandon Lavery from Rubenstein Law P.A., while the case has been filed under Case Number: 502024CA005742XXXAMB Div: AA.
